PHONEFUSION, INC. ("PhoneFusion", the "company", "us", "we" or "our") is committed to protecting the privacy of our customers' personal information. This statement applies with respect to the information that we collect from the company website, located at www.phonefusion.com .Amendments to this statement will be posted at this website and will be effective when posted. Your continued use of this site following the posting of any amendment, modification or change shall constitute your acceptance thereof.

What information do we collect?

We collect information from you when you register on the site, place an order, subscribe for services enter a contest or sweepstakes, respond to a survey or communication such as email, or participate in another site feature. When ordering, subscribing or registering, we may ask you for your name, e-mail address, mailing address, phone number, credit card information or other information. You may, however, visit our site anonymously. We also collect information about gift recipients so that we can fulfill the gift purchase. • create an eCommerce ecosystem combining the PhoneFusion services;

• organize and carry out PhoneFusion's and/or PhoneFusion marketing or promotional operations/offers and similar events; and
• protect your and PhoneFusion's interests, including in particular to enforce our Terms of Service and fight against fraud.

How do we protect visitor information?

We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. When you place orders, subscribe for services or access your personal information, we offer the use of a secure server. All sensitive/credit information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above.

PhoneFusion takes appropriate organizational and technical measures to protect the personal data and traffic data provided to us or collected by us, and does not retain it any longer than permitted in order to provide its services or as required under relevant law. Your personal and traffic data can only be accessed by authorized employees of PhoneFusion that need to have access to this data in order to be able to fulfil their given duties.

PhoneFusion takes appropriate technical measures to protect the confidentiality of the communications content via its PhoneFusion service, software, applications and other products, with due observance of the applicable obligations and exceptions under the relevant legislation.

Do we use "cookies?"

Yes. Cookies are pieces of information that the PhoneFusion software may store on your computer's hard drive through your web browser (if you allow) in order to help web applications to recognize you or your or preferences and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.

We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

PhoneFusion may share your information with other internal PhoneFusion entities for certain purposes, and in particular insofar as necessary to:

• create an eCommerce ecosystem combining the PhoneFusion services;
• provide and invoice certain joint services;
• organize marketing or promotional operations and similar events; and
• fight against fraud.

In order to provide you with PhoneFusion products and services you have requested, PhoneFusion may sometimes, if necessary, share your personal and traffic data with carriers, partner service providers and/or agents, for example the third party banking organization or other providers of payment services. PhoneFusion will always require these third parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant law.

Please be informed that, in any event a designated authority lawfully requests PhoneFusion or PhoneFusion's local partner to retain and provide personal data, communications content and/or traffic data, PhoneFusion and/or its local partner will provide all reasonable assistance and information to fulfill this request.

As PhoneFusion continues to develop its business, PhoneFusion might sell or buy subsidiaries or business units. In such transactions, as well as in the event PhoneFusion or substantially all of its assets are acquired by a third party, personal information of PhoneFusion users will generally be one of the transferred business assets. We reserve the right to include your personal information, collected as an asset, in any such transfer to a third party.

How can you opt-out, remove or modify information you have provided to us?

To modify your e-mail subscriptions, please let us know by modifying your preferences in the "My Account" section. Please note that due to e-mail production schedules you may receive any e-mail already in production.

To delete all of your online account information from our database, sign into the "My Account" section of our site and remove your shipping addresses, billing addresses and payment information. Please note that we may maintain information about an individual sales transaction in order to service that transaction and for record keeping.

Changes to our policy

If we decide to change our privacy policy, we will post those changes on this page. Policy changes will apply only to information collected after the date of the change. This policy was last modified on Feb 2008.

PhoneFusion reserves the right to modify the provisions of this Privacy Statement if deemed necessary. The revised Privacy Statement shall become effective within thirty (30) days of such publishing, unless you expressly accept the revised statement earlier by clicking on the accept button. You have the right to access and, where relevant, to rectify your personal data, provided that your identity can be verified.

If you would like to exercise your right to view, correct, complete or remove your personal data, please contact PhoneFusion at delete@phonefusion.com Within a reasonable period of time and upon verification of your identity and to the extent your request is legitimate, PhoneFusion will fulfill your request, provided PhoneFusion will not act contrary to applicable law by fulfilling your request.

You may also disallow to the processing by PhoneFusion to process your personal data by contacting PhoneFusion at privacy@phonefusion.com. In this case however, PhoneFusion will not be able to provide you PhoneFusion products, services and/or the PhoneFusion software.

PhoneFusion may also collect information about your usage of the PhoneFusion services, software, the websites and products. PhoneFusion reserves the right to utilize this information for marketing purposes, for instance by displaying selected comments on the website or in other communications. PhoneFusion reserves the right to share anonymous and aggregated information with third parties, for example to serve targeted advertising.

PhoneFusion may contact you to send you messages about faults and service issues. Further, PhoneFusion reserves the right to use e-mail or the PhoneFusion software to notify you of any eventual claims related to your use of PhoneFusion service, software, applications websites and/or PhoneFusion products, including without limitation claims of violation of third party rights.

PhoneFusion may also use e-mail or the PhoneFusion service, software, applications and/or products to keep you up to date with news about the PhoneFusion software, products and services that you have purchased and/or to inform you about other PhoneFusion products and services unless you have opted out of receiving this information. How Long is Your Personal Data Kept by PhoneFusion?

PhoneFusion will retain your information for as long as is necessary to:

• fulfill any of the purposes discussed in the "How do we use your information" section above; or
• comply with applicable law, regulatory requests and relevant orders from competent courts or government bodies.

Information outside PhoneFusion's control

Your User Profile

Your user profile is the information you decide to make available to the other PhoneFusion users. It may include your PhoneFusion user name, full name, address, telephone numbers, gender, date of birth, language, "about me" page URL, and any other information that you decide to make available. PhoneFusion does not store your user profile centrally on a server and does not have any control over it. In the event you choose to make your user profile available, this information is securely and temporarily transmitted to, and stored on computers of other users in the peer-to-peer network, in an encrypted format. You control your user profile and you can access your user profile from the "File" menu in the PhoneFusion software in order to view, correct, complete or remove information. Since your profile is not stored centrally or processed by PhoneFusion, PhoneFusion does not control it and cannot guarantee that this information will always be available and will not disappear.

In an attempt to provide you with increased value, we may include third party links on our site. Linked websites are not under the control of PhoneFusion. These linked sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites.
